- Acceptance of Terms
By accessing or using the Guest Advisor platform (“Platform”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Platform.
- Eligibility
To use the Platform, you must:
- Be a legally registered accommodation operator (e.g., hotel, motel, resort, caravan park, or Airbnb host).
- Agree to comply with all applicable laws and regulations.
- License to Use the Platform
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for the purpose of reporting and accessing incident reports related to guest misconduct.
- User Responsibilities
As a user of the Platform, you agree to:
- Provide accurate and truthful information when submitting incident reports.
- Only share information that you have the right to disclose (e.g., with guest consent where required).
- Use the Platform solely for its intended purpose and not for any illegal or unauthorized activities.
- Comply with all applicable privacy laws, including the Australian Privacy Act 1988.
- Incident Reports
- What You Can Share: First & Last name, Driver’s License number / Passport number. You may submit incident reports related to guest misconduct including but not limited to theft, property damage, noise complaints, and policy breaches.
- What You Cannot Share: You must not share personal information (e.g., credit card information, address details, email address) unless explicitly required by law.
- Accuracy: You are responsible for ensuring that all incident reports are accurate and verifiable.
- Data Ownership
- Our Rights: By submitting incident reports, you grant Guest Advisor a non-exclusive, worldwide, royalty-free license to use, store, and share the data within the Platform for the purpose of enhancing safety and security across the network.
- Prohibited Activities
You must not:
- Use the Platform to harass, defame, or harm others.
- Submit false or misleading incident reports.
- Attempt to gain unauthorized access to the Platform or its data.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if you violate these Terms of Use or engage in any prohibited activities.
- Disclaimer of Warranties
The Platform is provided “as is” and “as available.” We do not guarantee that the Platform will be error-free, secure, or uninterrupted. Use the Platform at your own risk.
- Limitation of Liability
To the fullest extent permitted by law, Guest Advisor shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
- Changes to These Terms
We may update these Terms of Use from time to time. Any changes will be posted on the Platform, and your continued use of the Platform constitutes acceptance of the revised terms.
- Governing Law
These Terms of Use are governed by the laws of Queensland, Australia. Any disputes arising from these terms shall be resolved in the courts of Queensland.
