Operator Agreement for Guest Advisor

Welcome to Guest Advisor Guest Advisor connects short term accommodation properties, marinas, tour & transport operators across Queensland (and eventually Australia) to improve guest behaviour and protect businesses. Our real-time check-in lookup helps you identify repeat offenders before they enter your premises. By using the Guest Advisor platform (“Platform”), you agree to these terms.

  1. Eligibility You may join the Platform if:
  • You are a registered business (motel, apartment, marina, tour operator, shuttle service, etc.) operating in Australia.
  • You comply with the Australian Privacy Act 1988, all other applicable laws, and agree to incorporate the Guest Advisor Addendum into your existing guest terms.
  1. Information We Collect Guest Data (used solely for real-time search at check-in):
  • First name, last name.
  • Driver’s license number (for Australian residents) or passport number (for international travellers).

Incident Reports:

  • Details of guest misconduct (e.g., theft, property damage, noise disturbances, rule/house policy violations, fraud). May include images.

Your Business Data:

  • Business name, contact details, property information.

Purpose: Guest data is used only at check-in to perform a real-time lookup. Guest Advisor does not retain personal ID data unless an incident report is submitted. No guest profiles are created unless misconduct is reported.

  1. How the Platform Works Check-In Lookup:
  • Enter a guest’s first name, last name, and ID at check-in.
  • The Platform instantly checks for any matching incident reports.
  • Guest ID data is not stored unless an incident is filed.

Incident Reporting:

  • If a guest violates policies, upload incident details (e.g., “Noise disturbance, 01/03/2025”) to the Guest Advisor database.
  • Guest IDs (driver’s license/passport numbers) are never shared with other members.
  • Incident reports may include supporting witness names and statements, which are stored securely and not shared externally.

Data Sharing:

  • Partners: Third-party tech providers receive minimal data under strict confidentiality agreements.
  • Legal Compliance: Data may be shared with authorities if required by law.
  1. Your Responsibilities
  • Accuracy: Enter guest names and IDs truthfully at check-in.
  • Transparency: Inform guests via registration cards, online check-in, or signage that: “Your information may be checked against the Guest Advisor Network to ensure safety and prevent misconduct.”
  • Compliance: Report incidents truthfully and promptly. False or malicious reports may result in termination or legal action.
  • Consent: Obtain explicit guest consent (via registration forms or digital check-in) before collecting or sharing their data.
  1. Security & Data Retention
  • Encryption: All data is encrypted in transit and at rest.
  • Access Control: Only authorized members can create incident reports and access results.
  • Retention: Incident reports are retained for 5 years, after which they are deleted unless required by law.
  1. Your Rights
  • Update/Delete Reports: Request corrections or deletions by emailing admin@guestadvisorhq.com. Deletion requests are processed within 30 days, subject to legal/safety obligations.
  • Opt-Out: Terminate your membership at any time by contacting Guest Advisor HQ.
  1. Acceptable Use Permitted:
  • Use the Platform to search the database and report incidents.

Prohibited:

  • Submit false or misleading reports.
  • Hack, reverse-engineer, or misuse the Platform.
  • Share guest IDs or incident history outside the Platform.
  1. Termination
  • By Us: We may suspend or terminate your access with notice (or immediately for serious breaches like fraud or hacking).
  • By You: Terminate your account at any time via written notice.
  1. Limitations of Liability
  • Platform Disclaimer: The Platform is provided “as is.” We do not guarantee uninterrupted or error-free service.
  • Liability Cap: To the extent permitted by law, Guest Advisor is not liable for indirect, incidental, or consequential losses.
  1. Updates & Governing Law
  • Changes: We may update these terms. Continued use after changes constitutes acceptance.
  • Jurisdiction: Governed by Queensland, Australia law. Disputes resolved in Queensland courts.
